TERMS OF SERVICE

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User”, “you”) and Tiki Entertainment LLC (“Company”, “we”, “us”, or “our”) governing your access to and use of the Tiki mobile application, website (if any), and related services (collectively, the “Platform” or “Services”).

By accessing, downloading, or using Tiki, you confirm that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy, Cookie Policy, and Community Guidelines.

If you do not agree, you must immediately discontinue use of the Platform.

1. Definitions

For the purposes of these Terms:

  • “Platform” refers to the Tiki mobile application and related services
  • “User Content” refers to any content shared by users, including text, voice, images, and profile data
  • “Voice Rooms” refers to real-time audio communication spaces
  • “Virtual Items” refers to any digital items, credits, or features (if applicable)

2. Eligibility & Age Requirements

2.1 You must be at least 18 years old to use Tiki, unless a lower age is permitted by applicable law with valid parental consent.

2.2 By using Tiki, you represent and warrant that:

  • You meet the minimum age requirement
  • You have the legal capacity to enter into this agreement
  • You are not prohibited from using the Services under applicable law

2.3 We reserve the right to request age verification and suspend or terminate accounts that provide false information.

3. Account Registration & Security

3.1 Account Creation

You may create an account using:

  • Google Sign-In (Firebase)
  • Apple ID (Back4App)

Passwords are not stored by us and are handled securely by third-party authentication providers.

3.2 Account Responsibility

You are solely responsible for:

  • Maintaining the confidentiality of your account
  • All activities conducted under your account
  • Any content shared through your account

3.3 Unauthorized Use

You agree to notify us immediately if you suspect unauthorized access or misuse of your account.

4. Acceptable Use & User Conduct

You agree to use the Platform in a lawful, respectful, and responsible manner.

4.1 Prohibited Content & Behavior

You must not upload, share, broadcast, or engage in content or behavior that includes, but is not limited to:

Harassment & Hate

  • Insults, bullying, threats, or intimidation
  • Hate speech based on race, ethnicity, nationality, religion, gender, sexual orientation, or disability

Sexual & Explicit Content

  • Pornographic or sexually explicit material
  • Sexual content involving minors (zero tolerance)
  • Unwanted sexual advances or explicit language

Violence & Illegal Activity

  • Promotion of violence or self-harm
  • Terrorism, extremism, or criminal acts
  • Drug trafficking or illegal services

Fraud & Impersonation

  • Impersonating another individual or organization
  • Scams, phishing, or deceptive behavior

Privacy Violations

  • Sharing personal data without consent
  • Recording or distributing conversations illegally

Spam & Abuse

  • Repetitive or automated messages
  • Manipulating rooms, rankings, or engagement metrics

5. Voice Rooms & Live Audio Rules

5.1 Voice Rooms involve real-time interaction and may not be pre-moderated.

5.2 Users acknowledge that:

  • All speech is the sole responsibility of the speaker
  • Hosts may establish additional room rules
  • Violations may result in immediate removal

5.3 Recording or redistributing voice content without legal consent is prohibited.

6. User Content & License

6.1 Ownership

Users retain ownership of their User Content.

6.2 License to the Company

By posting content, you grant Tiki Entertainment LLC a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, modify, distribute, and display such content solely for operating and improving the Platform.

6.3 Content Moderation

We reserve the right to remove or restrict content at our discretion.

7. Reporting, Moderation & Enforcement

7.1 Users may report violations using in-app tools.

7.2 Enforcement actions may include:

  • Content removal
  • Temporary restrictions
  • Muting or room removal
  • Account suspension or termination

7.3 Decisions are based on severity, frequency, and risk.

8. Virtual Items & Paid Features (If Applicable)

8.1 Virtual items have no real-world monetary value.

8.2 Purchases are non-transferable and non-refundable unless required by law.

8.3 We reserve the right to modify or discontinue virtual items.

9. Third-Party Services

The Platform integrates services from:

  • Back4App
  • Firebase (Google)
  • Apple
  • ZEGOCloud

We are not responsible for third-party services or content.

10. Suspension & Termination

10.1 You may terminate your account at any time.

10.2 We may suspend or terminate accounts for:

  • Violations of these Terms
  • Harmful or abusive behavior
  • Legal or regulatory requirements

10.3 Termination may result in loss of content or access.

11. Disclaimer of Warranties

The Platform is provided “AS IS” and “AS AVAILABLE” without warranties of any kind. We do not guarantee uninterrupted or error-free service.

12. Limitation of Liability

To the maximum extent permitted by law, Tiki Entertainment LLC shall not be liable for indirect, incidental, or consequential damages.

13. Indemnification

You agree to indemnify and hold harmless the Company from claims arising out of your use of the Platform or violation of these Terms.

14. Changes to These Terms

We may modify these Terms at any time. Continued use of the Platform constitutes acceptance of the updated Terms.

15. Governing Law & Jurisdiction

These Terms are governed by applicable laws governing Tiki Entertainment LLC, without regard to conflict of law principles.
